Will Um is a nationally recognized litigator who focuses his practice on complex business litigation, insurance recovery advice, and related coverage litigation. He advises and represents corporate policyholders in complex insurance coverage claims relating to a variety of matters including class actions, media liability, data breach and privacy issues, professional services liability, directors and officers liability, intellectual property disputes, and various environmental and toxic tort matters. Will also handles general business litigation matters involving complex commercial contracts, fraud and misrepresentation claims, and unfair competition and unfair business practices. Over the course of his career, Will has helped his clients recover hundreds of millions of dollars in various types of insurance matters. Will’s clients include internet and media entities, financial institutions, aerospace companies, and professional services entities.
Will has handled major, multi-party complex litigation matters in both state and federal courts. In addition to trial work, he has served as lead counsel in arbitration proceedings across the country and secured numerous multi-million dollar arbitration awards, including one of the largest defense fee arbitration awards in California history.
Will is a frequent guest lecturer at the University of California, Irvine School of Law, and provides professional commentary to various major legal publications in the area of insurance law. He is a frequent writer and speaker, and has led several conference panels on insurance and litigation-related topics.
NOTABLE REPRESENTATIONS
Representation of internet and media company: Will has been insurance recovery counsel for a major multinational technology company for all insurance related matters for almost a decade. In one matter, Will obtained a favorable, multimillion dollar settlement for the client from insurance carrier, AIG, after the conclusion of a multi-year confidential arbitration proceeding.
Representation of publicly traded management investment company: Will helped secure over $50 million of insurance coverage from several insurance carriers to help settle underlying securities and derivative lawsuits alleging various claims following data breach and privacy incidents.
Representation of Fortune 500 aerospace company: Will obtained one of the largest fee recovery awards in a Cumis counsel fee arbitration relating to defense of multiple complex underlying toxic tort actions.
Representation of accounting firm: Will was counsel for a professional services company that provides a full range of business services including accounting, tax, benefits, and insurance. He helped secure critical and necessary insurance coverage for the funding of several million dollars of defense expenses and settlement to resolve an underlying accounting fraud lawsuit.
Representation of entertainment studio client: Will helped secure over $10 million in insurance coverage from directors and officers liability carrier to help fund various underlying securities and derivative lawsuits.
Representation of major law firm: Will successfully represented corporate partnership in securing insurance coverage to fund settlement of underlying employment and partnership dispute.
